These Terms of Use (“Terms”) govern your access to and use of www.push.agency (the “Site”), operated by PUSH Media Inc. (“PUSH Media,” “PUSH,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms apply to the Site only. Any services PUSH provides to clients are governed by a separate written agreement, which controls if it conflicts with these Terms.

1. Using the Site

You may use the Site for lawful purposes and in line with these Terms. You agree not to:

  • Use the Site in any way that breaks applicable laws or regulations.

  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems.

  • Introduce viruses, malware, or other harmful code, or interfere with the Site’s operation.

  • Use bots, scrapers, or other automated tools to copy or collect content or data from the Site without our written permission.

  • Submit false information or impersonate any person or organization.

2. Intellectual property

The Site and its content, including text, graphics, logos, case studies, images, video, and code, are owned by PUSH or our licensors and are protected by copyright, trademark, and other laws. Client names, logos, and work shown on the Site belong to their respective owners.

You may view and share links to Site content for personal or internal business reference. You may not copy, reproduce, modify, distribute, or create derivative works from Site content without our prior written consent.

3. Information and insights

Articles, reports, benchmarks, and other content on the Site are provided for general information only. They are not professional, legal, or financial advice, and results described in case studies are not a guarantee of future results. You should seek advice specific to your situation before acting on any content.

4. Your submissions

When you submit information through the Site, you confirm that it is accurate and that you have the right to share it. Our Privacy Policy explains how we handle it.

If you send us unsolicited ideas, proposals, or creative materials, you agree that PUSH is under no obligation to keep them confidential or to compensate you, and that we may use similar ideas developed independently. Please do not send confidential information unless we have a written confidentiality agreement in place.

5. Third-party links and services

The Site may link to third-party websites or embed third-party content. We do not control and are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

6. Disclaimer

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, PUSH disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

7. Limitation of liability

To the fullest extent permitted by law, PUSH and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of, or inability to use, the Site. Our total liability for any claim relating to the Site will not exceed CAD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

8. Indemnity

You agree to indemnify and hold harmless PUSH and its directors, employees, and partners from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

9. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute relating to these Terms or the Site.

10. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms by posting a revised version and changing the “Last updated” date. Your continued use of the Site after changes are posted means you accept the updated Terms.

11. General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and PUSH about the Site.
